Czech Constitutional Court backs state over solar clampdown

The Czech Constitutional  Court has broadly backed the government’s right to put a brake on a solar power boom through retroactive taxes. It  pointed out that though the blanket measure may have badly hit smaller investors counting on quick returns after taking out high interest loans the government had to have lee way to react to events.

Foreign investors in Czech solar plants to sue state over retro tax

Ever since the Czech government pushed through a retroactive 26 percent tax on solar companies’ profits at the end of 2010 to stem an ongoing solar power boom the threat of a massive law suit has loomed large. Now, 11 foreign investors, all members of the International Photovoltaic Investors Club (IPVIC), have told the Ministry of Finance that within six to eight weeks they will file a lawsuit against the Czech state.

Czech power regulator seeks to stamp out renewables support

The not-so-sunny Czech Republic is fourth in the world for its solar power capacity thanks to over generous grants in the past which sparked a boom. Now the Energy Regulatory Office (ERÚ) wants to curb any chance of any similar renewable El Dorado at the expense of the taxpayer with a ban on virtually all new support proposed from 2014.

Czech renewable power group says Brussels questioning grid connection ban

Platforma pro OZE, a local association championing the rights of renewables power companies, says proceedings started by the European Commission are a lot wider than just taking the Czech Republic to task over its failure to push through legislation on time. Brussels is also looking into the ongoing refusal to connect wind and solar plants because it could threaten the electricity grid, it says.

Czech energy regulator probing solar power boom

Energy Regulation Authority (ERÚ) head Alena Vitásková has launched independent audits to investigate the circumstancs surrounding the costly solar power boom in the Czech Republic and pledges she will not allow something similar to happen again. She had already pinpointed one danger from hastily drawn up laws aimed at boosting the use of biogas and says the ERÚ will take a stand against them.

Czechs to recruit ‘dream team’ of star lawyers for solar battle

The main architect of the Czech state’s legal defense strategy in the looming solar arbitration battle — which, if lost, could cost taxpayers hundreds of billions of crowns — has shown Czech Position a few of the cards in his tightly held hand. Radek Šnábl, an adviser to Finance Minister Miroslav Kalousek (TOP 09), is looking to assemble a “dream team” of expert arbitration lawyers from the four corners of the Earth. And talk of a financial settlement is nonsense.

Czechs seek emergency steps over solar arbitration threat

The Finance Ministry is citing the threat to the country’s financial stability and security in an attempt to ditch normal public tender rules and quickly select a legal team to take on foreign solar power investors in a looming arbitration. The gov’t long played down the threat, saying it had a watertight case for measures it took to curb a costly solar power boom; now, prospects seem less sunny.

Czech financial investigators probe huge ČEZ solar farms

The special auditing section of the Finance Ministry is investigating how two massive wind farms were built by Czech state-controlled power giant ČEZ in the north of the country. The probe reportedly centers on the company Amun.Re, which acted as a middle man in the construction after ČEZ bought the ready prepared projects, according to business daily Hospodářske noviny. ČEZ said the construction costs were reasonable.

Ex-coal baron takes lead in solar cause

Former Czech Coal co-owner Petr Pudil is now heavily involved in solar power through the renewable power company Ren Power and involvement in the grouping of Czech and international investors that have taken the lead in launching arbitration proceedings against the state over a retroactive tax. But Pudil says he has no plans to join in a legal dispute against the state.

More solar investors to sue Czech state

Domestic law firm Glatzová & Co. and Anglo-German firm FBD were the first to have formally informed Czech authorities of their respective clients intention to launch arbitration against the Czech state over the “solar tax.” Now the lesser-known firm Smed Jorgensen is set to follow suit and is joining forces with high-profile arbitrator Ondřej Sekanina.
